By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, please do not use the Site or purchase products from us.

1. Eligibility and Use of the Site

However, colors, dimensions, appearance, and other product details may vary slightly because of monitor settings, photography, natural design variations, manufacturing processes, or other factors.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, reject orders, or make substitutions only with your approval where appropriate.

If a product you ordered becomes unavailable, we may contact you to offer an alternative product, place the order on hold, or cancel the affected portion of the order and issue an applicable refund.

4.3 Gemological Certification

Where applicable, lab-grown diamonds may be accompanied by a gemological report or certification, including reports issued by organizations such as IGI or GIA. Certification information, when included, will be identified in the applicable product description or order documentation. Any physical certificate included with the product will be shipped with the order.

5. Pricing, Taxes, and Payment

5.1 Pricing

Unless otherwise stated, all prices displayed on the Site are in U.S. Dollars (USD). Product prices may not include applicable taxes, shipping charges, customs duties, tariffs, or other fees.

We reserve the right to change prices at any time without prior notice. Price changes do not affect orders that we have already accepted, except where a pricing, listing, or technical error has occurred.

If we identify a pricing or listing error after an order is submitted, we may contact you to confirm the corrected price or cancel the affected item or order and issue a refund.

6. Order Processing and Acceptance

Due to security, fraud-prevention, payment-verification, and carrier requirements, the shipping address cannot be changed after an order has been submitted.

If you notice an error or need to cancel an order, contact us immediately. If the order has not entered processing or fulfillment, we may be able to cancel it so that a new order can be placed with the correct information. Cancellation is not guaranteed.

Once an order has entered processing, production, fulfillment, or shipment, we may be unable to modify or cancel it.

6.3 Custom and Made-to-Order Products

Custom, personalized, resized, engraved, or made-to-order products may enter production shortly after the order is accepted. Changes or cancellations may not be possible once production has begun. Additional charges may apply to approved changes.

7. Shipping and Delivery

7.1 Domestic Shipping

We may provide free shipping on eligible orders shipped within the United States unless otherwise stated on the product page, during checkout, or in a promotional offer.

Available shipping methods, costs, and estimated delivery times may vary depending on the destination, product, order value, availability, production time, and carrier.

Once an order ships, we will generally provide a shipping confirmation and tracking information using the contact details supplied with the order.

7.2 Shipping Address Accuracy

You are responsible for providing a complete, accurate, and deliverable shipping address before submitting your order.

Due to security and fraud-prevention policies, we cannot change, replace, or redirect the shipping address after an order has been submitted. This restriction applies even when the order has not yet shipped.

If you identify an address error, contact us immediately. At our discretion, and only if processing has not begun, we may be able to cancel the order so that you can place a new order using the correct address.

We are not responsible for delays, losses, additional fees, or failed deliveries caused by an incomplete, inaccurate, outdated, or undeliverable address supplied by the customer.

7.3 Processing and Delivery Estimates

Any processing, production, shipping, or delivery dates provided by us are estimates unless we expressly state otherwise in writing.

Delivery timing may be affected by product availability, customization, verification procedures, carrier operations, weather, holidays, customs processing, incorrect addresses, or other circumstances outside our reasonable control.

We do not guarantee a specific delivery date unless a written guarantee is expressly provided by us.

7.4 Risk of Loss

Unless otherwise required by applicable law or agreed in writing, products are shipped under a shipment contract. Risk of loss and title pass to you when we deliver the products to the carrier, subject to any applicable shipping insurance or consumer protection rights.

If tracking shows that a package was lost, damaged, or delivered incorrectly, contact us promptly so that we can review the matter and, where appropriate, assist with a carrier claim.

7.5 International Orders

We may offer international shipping to certain countries or regions. International shipping is available only when the destination is offered during checkout or separately approved by us before the order is placed.

An order submitted with a United States shipping address cannot later be changed, redirected, or forwarded by us to an international address.

7.6 Refused, Returned, and Undeliverable Shipments

If a shipment is refused, returned to us, or determined to be undeliverable because of an incorrect or incomplete address, failed delivery attempts, unpaid customs charges, refusal to accept the package, or another issue outside our control, we may deduct applicable shipping, return-shipping, customs, handling, insurance, or restocking costs from any refund, to the extent permitted by law.

Original shipping charges, customs duties, taxes, and related fees may be non-refundable.

If an order is returned to us and you request reshipment, you may be responsible for additional shipping and handling charges. Reshipment is subject to product condition, availability, carrier restrictions, and our approval.

8. Returns, Exchanges, and Refunds

8.1 Return Policy

We want you to be satisfied with your purchase. Unless a different policy is stated on the product page or at checkout, eligible products may be returned within 30 days from the date of delivery.

To qualify for a return, the product must be unworn, undamaged, unaltered, and in its original condition. It must also include all original packaging, certificates, reports, accessories, tags, and documentation.

Returns must follow our return authorization and shipping instructions. Products sent without authorization may be refused or returned to the sender.

Approved refunds will generally be issued to the original payment method, subject to applicable deductions and processing times.

Unless otherwise stated or required by law, original shipping charges, expedited shipping charges, international shipping costs, customs duties, taxes, and return-shipping charges are non-refundable.

If a return results from our error or a verified product defect, we will provide appropriate instructions and determine the available remedy under applicable law and our policies.

9. Warranty and Repairs

9.1 Warranty Coverage

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ALL PRODUCT DESCRIPTIONS, IMAGES, OR OTHER CONTENT WILL BE COMPLETELY ACCURATE OR CURRENT.

13. Limitation of Liability

13.1 Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASSEL AND CO, INCASTLE LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OUR SERVICES, OR PRODUCTS PURCHASED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OUR SERVICES, OR A PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

13.3 Rights That Cannot Be Limited

Some jurisdictions do not permit the exclusion of certain warranties or the limitation or exclusion of certain damages. In those jurisdictions, the exclusions and limitations in these Terms apply only to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Assel and CO, Incastle LLC, and their respective officers, directors, members, employees, agents, contractors, service providers, and affiliates from and against claims, liabilities, damages, judgments, awards, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to:

(a) your breach of these Terms;

(b) your misuse of the Site or our services;

(c) your violation of any applicable law; or

(d) your violation of a third party’s rights.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms and any dispute arising out of or relating to them, the Site, our services, or products purchased through the Site will be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.

15.2 Venue and Jurisdiction

Subject to Section 15.3, any legal action arising out of or relating to these Terms, the Site, our services, or products purchased through the Site must be brought in the state or federal courts located in King County, Washington.

You consent to the personal jurisdiction and venue of those courts, except where applicable law provides otherwise.

15.3 Arbitration Option

To the extent permitted by applicable law, we may require a dispute arising out of or relating to these Terms, the Site, our services, or products purchased through the Site to be submitted to final and binding arbitration administered under the applicable rules of the American Arbitration Association.

Unless otherwise agreed, arbitration will take place in Seattle, Washington. This provision does not prevent either party from seeking relief in small claims court or requesting temporary or injunctive relief where permitted by law.

16. Changes to These Terms

We reserve the right to modify or update these Terms at any time.

When changes are made, we will post the revised Terms on the Site and update the “Last Updated” date. Changes become effective when posted unless otherwise stated.
